Geneva man faces child abuse charges

A baby was brought into the emergency room of St. Mary's Hospital in Rochester on January 11, 2011. After careful examination of the child, it was determined that a crime had been committed against this three-month-old infant .

Mandated by law, the incident was reported to authorities by a hospital social worker. The injuries are believed to have happened sometime between Dec. 28, 2010, and Jan. 11, 2011 while the child’s mother was at work.

“The infants ability to develop and function has been severely limited by the injuries inflicted,” the court complaint states. “He has serious vision problems or will be blind. It is also anticipated that he will never be able to walk. He will require special services, occupational and physical therapies, ongoing medical care, numerous medications, and will need someone to provide for his personal care needs.”

A 28-year-old Geneva man has made his first appearance in Freeborn County District Court on Wednesday, June 8, on allegations that he physically abused his 3-month-old child, that led to the severe brain injuries. According to court documents, Cory Craig Bailey is accused of abusive head trauma to his son. The trauma sustained is so serious that the infant’s development and functioning level will remain that of an infant for the duration of his life. Bailey is also accused of denying the child, now 8 months old, of essential health care after the alleged incident.

Bailey reportedly told police that the baby’s head hit a door frame while he was carrying the child walking through a door, although medical professionals have stated the injuries were too serious to have been caused in this manner. Court documents state the baby’s injuries are consistent with “non-accidental trauma.”

Bailey faces six felonies tied to the allegations: one count of first-degree assault, one count of child endangerment, three counts of malicious punishment of a child and one of child neglect.

The child was treated for more than a month at St. Mary’s Hospital before being released to his mother. He was in critical condition until February 7, and was placed in a medically-induced coma due to massive seizures.

In court last Wednesday, Steve Schwab, Freeborn County District Court Judge, gave Bailey two options: the first, that he be held on $100,000 unconditional bail; or secondly, that he instead may choose to be allowed to return at the next hearing on his personal promise to appear, if he followed some conditions.

Those conditions included signing a waiver of extradition, adhering to a safety plan already approved by the court, not living at the home with the baby, complying with random drug tests and not using any illicit drugs or alcohol while the matter is pending. He must also obey the law, be of good behavior, and not leave the state without prior court permission.

He is not allowed to see the youngster, and his other child except through supervised visits. His next scheduled appearance of this matter is July 18 at 1:30 p.m.
