Bailey reportedly told police that the baby’s head hit a door frame while he was carrying the child walking through a door, although medical professionals have stated the injuries were too serious to have been caused in this manner. Court documents state the baby’s injuries are consistent with “non-accidental trauma.”
Bailey faces six felonies tied to the allegations: one count of first-degree assault, one count of child endangerment, three counts of malicious punishment of a child and one of child neglect.
The child was treated for more than a month at St. Mary’s Hospital before being released to his mother. He was in critical condition until February 7, and was placed in a medically-induced coma due to massive seizures.
In court last Wednesday, Steve Schwab, Freeborn County District Court Judge, gave Bailey two options: the first, that he be held on $100,000 unconditional bail; or secondly, that he instead may choose to be allowed to return at the next hearing on his personal promise to appear, if he followed some conditions.
Those conditions included signing a waiver of extradition, adhering to a safety plan already approved by the court, not living at the home with the baby, complying with random drug tests and not using any illicit drugs or alcohol while the matter is pending. He must also obey the law, be of good behavior, and not leave the state without prior court permission.
He is not allowed to see the youngster, and his other child except through supervised visits. His next scheduled appearance of this matter is July 18 at 1:30 p.m.
